The usefulness of this book depends entirely on the reader's legal experience. If you are thinking about law school, are a first year student, or have no experience in moot court/ mock trial, I can see it being very beneficial, because it lays out basic principles cogently. However, you are anything more than a second-year law student, this book is a bit of a waste of money. The content in the book is basically covered in first year civil procedure, or any basic moot court class you will have done. There is little added insight from a rhetorical perspective. I wouldn't buy it again for myself, but I would give it to a high school debater who is thinking about law as a potential career path.
The best book for any person who wants to understand how American Courts work! At times we all ask questions like "How can this criminal get off on technicalities if it is obvious that he/she committed crime?", or "How can this be fair?" or "How can a lawyer defend this "bad guy/girl"? This is totally wrong! He/she is a criminal!" The author explains the difference between law and common sense, law and ethics, understanding of crime in legal terms and in laymen words.The book closely examines the logical reasoning of the law professionals , demonstrating the "tricks" used in court rooms. Fascinating reading!!! WARNING: the book will not prepare you to go to court and defend your case! This is not a "how-to" manual for folks who are planning to go to court. Hire a lawyer if need be.However, if you want to learn how to present and defend your point (any point, not just legal issues) as an intelligent and convincing person, this book is for you! Chances are, by the time you are done with debating your next case, your opponents will at least respect your opinion (or hate your guts, which still might give you some satisfaction).This book is for anyone who wants to boost up their skills in logical persuasion, finding loopholes in opponent's logical reasoning.Lots of interesting and valuable information for a pretty small price! It is written in a short and clear format: each chapter discusses specific idea, giving examples from court cases and average daily life (parent-child, husband-wife, employee-supervisor), concluding with a practical application summary argument vs. counterargument. So, no reason to read the entire book from beginning to end. One can just pick any chapter and read about how this or that legal (logical) rule can be applied in daily life.
If you *aren’t* an attorney or in law school, this book may be very helpful and a fun read. It covers extremely basic concepts which may be valuable to some people. For me, this book wasn’t a great read.The author really waters down legal concepts, which just isn’t helpful for law students and attorneys. In other words, this is like one of those “law for dummies†books. Fun book- but not to be used by people who are actually in the field of law. If you’ve already taken the LSATS or the BAR exam, don’t bother buying this book. If you’re a high school student considering studying law in one day, this book may be a fun “intro†for you.
This book is super easy to read because Trachtman organizes the material very well and provides excellent examples that demonstrate his points and counterpoints. I've had rhetoric and critical thinking courses and this book covers the same persuasive techniques but in an easy-to-understand, real-world useful way, free of abstractions. When Trachtman uses legal terms--often, Latin words--he translates and explains them so you know what he's talking about. He keeps things short and moving, covering only the essentials to make his point. I read this in a couple sittings and will use it as a reference often. It teaches me how to support my claims or deflect or challenge the opposition--whether I'm asking my boss for a raise, challenging someone on Twitter, or arguing with the cable company.
This is a good read but sometimes a little advanced for the layman. It is very interesting to realize the considerations for dealing with different countries laws. It makes you open your eyes to the many things you have to consider when dealing with different people and situations. I enjoyed it.
This book is not going to magically turn you into a great debater, that requires years of training and raw talent, but this is a great resource that breaks down the logical components that accompany strong argumentation, and breaks down the logical components behind taking down opposing arguments. It's also a fun read and extremely digestible.
Bought this for my friend who is currently studying law. She absolutely loves it and says, it's the best gift she has received. I strongly recommend this book for law students.
